These Terms of Service ("Terms") govern your access to and use of Hearrd ("Service," "we," "us," or "our"), a voice journaling application. By creating an account, accessing, or using Hearrd, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Acceptance of Terms
By using Hearrd, you represent and warrant that:
- You are at least 13 years of age (or the age of majority in your jurisdiction)
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- All information you provide is accurate and truthful
- You will not use the Service for any illegal or unauthorized purpose
Description of Service
Hearrd is a voice journaling application that allows you to:
Record voice entries: Capture your thoughts, feelings, and experiences through voice recordings.
Transcribe recordings: Automatically convert your voice recordings into text format.
Generate insights: Receive AI-powered analysis and patterns from your journal entries to help you understand yourself better.
Store and organize: Securely store and organize your journal entries for future reference.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that may affect your use of the Service.
User Accounts and Responsibilities
Account Creation
To use Hearrd, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
Account Security
You are solely responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized access to your account.
Account Termination
You may delete your account at any time through the app settings. Upon account deletion, all your data will be permanently removed in accordance with our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use Policy
You agree not to use Hearrd to:
- Violate any applicable laws, regulations, or third-party rights
- Upload, record, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service or any other accounts, systems, or networks
- Use automated systems (bots, scrapers, etc.) to access the Service without our express written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit any viruses, malware, or other harmful code
- Collect or harvest information about other users without their consent
Violation of these rules: We reserve the right to investigate violations of these Terms and may take appropriate legal action, including but not limited to suspending or terminating your account and reporting violations to law enforcement authorities.
Intellectual Property Rights
Your Content
You retain all ownership rights to the content you create, record, or upload to Hearrd (your "User Content"). By using Hearrd, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you.
Our Service
The Hearrd Service, including its design, features, functionality, and all related intellectual property, is owned by us or our licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
Trademarks
"Hearrd" and our logo are trademarks owned by us. You may not use our trademarks without our prior written consent.
Disclaimers
Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
AI Insights
The AI-powered insights and analysis provided by Hearrd are for informational purposes only and should not be considered as professional medical, psychological, or therapeutic advice. Always consult qualified professionals for health, mental health, or therapeutic concerns.
Third-Party Services
Hearrd may integrate with third-party services (such as transcription providers). We are not responsible for the availability, accuracy, or content of such third-party services.
Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater
- We are not responsible for any loss or damage resulting from unauthorized access to your account or data, including but not limited to hacking, security breaches, or your failure to maintain account security
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Hearrd, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (d) any claim that your User Content caused damage to a third party.
Termination
Termination by You
You may terminate your account at any time by deleting it through the app settings. Upon termination, your access to the Service will immediately cease, and your data will be deleted in accordance with our Privacy Policy.
Termination by Us
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or illegal activity; (c) extended periods of inactivity; or (d) requests by law enforcement or other government agencies.
Effect of Termination
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice in the app at least 30 days before the changes take effect. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hearrd operates, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If we cannot resolve a dispute through negotiation, you agree to first contact us to seek an informal resolution. If informal resolution is not possible, disputes will be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hearrd regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
